HOUSTON, TEXAS - May 28, 2019. The day after Memorial Day, it was a very “American” result, Jeff Diamant prevails in Court on the case of the wrongfully convicted Carlos and Jemima Guimaraes, who stood accused of aiding in the alleged kidnapping of their grandchild. “The Court’s ruling embodied the American system of justice,” Diamant said about the hearing. He continued, “The Court’s ruling sends a clear message. . . in this country, you cannot defraud our courts and get away with it.”

The Guimaraes’ former son in law, accused sexual deviant and domestic abuser Dr. Christopher Brann, filed a motion to dismiss the Guimaraes suit alleging fraud on the court and other actions attempting to hide behind the Texas Citizen’s Participation Act (the Anti-SLAPP Statute), often described as a “procedural freak show.” Brann’s motion attempts to claim immunity from suit for Brann based on some protected right of free speech contending that any fraud he committed cannot be prosecuted as it was a matter of public interest, and occurred in a judicial proceeding and subject to a judicial privilege. Diamant argued that a decision to dismiss the action is tantamount to giving people a ready made formula for fraud, that is, as long as someone can dupe a court into a ruling in their favor, their fraud is now protected.

The Court disagreed.

In a nearly instantaneous ruling following arguments of counsel, the Court denied Brann’s motion, allowing the case to go forward.

“This is a big win for the Guimaraes family and what may be the first time that justice is served in this tragic tale,” said Diamant.

The Guimaraes’ daughter, Marcelle, left to Brazil and would not return to the US during the pendency of her divorce to escape what was both a pattern of domestic violence perpetrated by her former husband, Brann, and some good old fashioned family court pay-for-play justice being served up by the former judge of that court, the often-alleged corrupt James Lombardino.
